AUTHORISATIONS TO WORK AND RESIDE IN SPAIN

The authorisations required to live and work in Spain depend on workers’ country of origin.


Procedures vary depending on the length of the stay in Spain, whether the workers are self-employed or salaried and, in the latter case, whether they are working for a Spanish or a foreign company.

AUTHORISATIONS FOR WORKERS IN AUDIOVISUAL PRODUCTIONS IN SPAIN

The entry and permanence procedure for professionals from third countries carrying out an activity in the audiovisual sector is regulated by Law 14/2013 of 27th September on support for entrepreneurs and their internationalisation.

This initiative is part of the development of the Spain, Audiovisual Hub of Europe Plan , included in the Recovery, Transformation and Resilience Plan. This plan highlights the need to adopt the necessary regulatory measures in order to simplify administrative procedures for authorisations and visas in this sector as a result of its economic interest.

In this sense, three entry and permanence options are established for foreign professionals who carry out activities in the audiovisual sector.

1. A first route is established for audiovisual professionals who are going to stay in Spain for up to 90 days within a period of 180 days, who will be exempt from the obligation to obtain a work permit and a visa if they come from those countries exempt from visa requirements, according to Community regulations.

2. The second route is for audiovisual professionals who are going to stay in Spain for more than 90 days, up to a maximum of 180 days. In these cases, foreigners will be able to obtain a visa that will be sufficient to stay and carry out their activity in Spain for the duration of their stay. In addition, foreigners who initially came to Spain for a 90-day stay within a period of 180 days may, exceptionally, apply for a residence permit for the audiovisual sector for a maximum period of 180 days.

3. For the third route, a residence permit is developed as a single permit for those foreigners who are going to reside and work in the audiovisual sector for more than 180 days.

All three entry and permanence options contemplate the possibility that the artists or professionals may stay in Spain with their direct family members. This new procedure also enables artists or professionals who are not of legal age to travel to Spain and carry out their activity in the audiovisual sector, provided they are accompanied by their parents.
