Minors under 16 years of age that have leading or secondary roles in an audiovisual work must have a contract that includes specific requirements and characteristics, pursuant to legislation, included in Royal Decree 1435/1985 of 1st August, regulating the special labour relations of artists in public spectacles, as specified in article 2 thereof. Regarding the capacity to hire, it states that, “in exceptional cases, the labour authority may authorise the participation of minors under sixteen years of age in public spectacles, provided that said participation does not represent a danger to their physical health or their professional and human education”.

The minors’ legal representatives are required to present the corresponding authorisation, as well as the minors’ written consent, should they have sufficient capacity, including specific details of the spectacle in question. Once authorisation has been granted, the minors’ legal representatives must sign a performance job contract pursuant to the provisions of Legislative Royal Decree 2/2015 of 23rd October. The parent or legal guardian shall be responsible for exercising the actions arising from this contract.

Given the complexity and importance of these procedures, you are advised to contact the film commission or film office in the territory where filming is to take place to obtain details of the specific requirements for each territory and the procedure to be followed, as processing takes place in each autonomous community before the competent labour authority.
